When an arrest is made without the established legal requirements —without flagrancy, without a court order, without reasonable evidence, or outside the maximum time limits— the law does not remain silent. Its resolution must be issued within a maximum period of 24 hours, with immediate hearing of the person deprived of liberty.

It is activated, among other circumstances, when:

• The legal 72-hour detention period is exceeded without appearing before a judge.
• The detainee is not properly informed of the reasons for their arrest.
• The right to legal assistance or to communication with a family member is not respected.
• The arrest is not properly documented or justified (art. 520.2 LECrim).
• The deprivation of liberty has been based on arbitrary or insufficient elements.
