Differences with other property crimes

The differences between breach of fiduciary duty, fraud and embezzlement lie in the typical elements of each offense, such as the protected legal interest, the form of commission and the harm caused.

Fraud

The offense of fraud punishes whoever induces error in another person through prior deception to achieve a transfer of assets to the detriment of the victim. The elements of fraud are:

  • There exists an obligation of restitution or delivery, which is not fulfilled.
  • It is consummated when the active subject definitively incorporates the property into their assets.
