How cryptocurrency fraud is regulated in the criminal code

In Spain, cryptocurrency fraud is prosecuted under article 248 of the Criminal Code:

«Anyone who, with intent to profit, deceives another by inducing them to perform an act of disposition to their own or another’s detriment commits fraud

The use of technology does not change the essence of the crime, but it does influence its classification and penalties. In many cases, aggravating factors are applied for the use of technological means, membership in a criminal organization, or affecting multiple victims.

Types of cryptocurrency fraud in Spain and how they operate

  1. Fake investment platforms – They simulate being regulated exchanges, show manipulated charts, and disappear with the funds.
  2. Ponzi and pyramid schemes – They pay old investors with new money until they collapse.
  3. Rug pulls – Token creators who flee with the funds after a launch.
  4. Pump and dump – They artificially inflate the value of a cryptocurrency and sell massively.
  5. Romance fraud – Use of false relationships to induce investments or transfers.
  6. Report immediately

    The first step is to report immediately, without waiting to «gather more evidence» or to «speak with the platform first».

    How to report a crypto scam

    File your complaint with:

    • National Police – Economic and Tax Crime Unit (UDEF) or the Unit
    • Civil Guard – Central Technological Investigation Brigade (BCIT) against cybercrime.
    • Prosecutor’s office specialized in economic crimes (if the amount is high or there are multiple victims).
    • INCIBE – to receive guidance and activate preventive alerts.

    Include in your complaint:

    • Precise chronology of all events.
    • Complete details of the advisor, intermediary or platform involved.
    • Wallet addresses and details of the transactions made.
