How does the role of the agent provocateur affect the theory of entrapment?

The entrapment occurs when an individual commits a criminal offense as a direct result of incitement by an agent provocateur. It is not a voluntary act, but conduct artificially generated by a police authority or a collaborator of the security forces.

For entrapment to exist, certain elements must be present:

  • The initiative for the crime comes from the agent provocateur. Police action is not limited to observing or documenting an existing crime, but actively creates the criminal situation.
