What is involuntary manslaughter?

Involuntary manslaughter occurs when a person causes the death of another without intent to do so, but through conduct that violates the duty of care. That is, they didn’t want to kill, but they acted carelessly, dangerously or recklessly.

This type of offense is regulated in Article 142 of the Spanish Criminal Code. The key is determining the degree of negligence with which one acted:

  • Gross negligence: very dangerous and negligent conduct.
  • Ordinary negligence: careless conduct, but not extreme.

The difference is not minor. The classification can mean years in prison or a simple fine. And that’s why you need a technical, specialized and strategic defense.

It should be noted that, unlike intentional homicide, involuntary manslaughter is not under the jurisdiction

When does gross negligence become ordinary negligence in an involuntary manslaughter offense?

In September 2025, the Supreme Court resolved a case that marked a turning point in the analysis of involuntary manslaughter. The key was a question that could change the future of any defendant:

What happened?

A 38-year-old man was walking with his partner when he witnessed a 91-year-old man hitting his wife with a cane in the middle of the street. The defendant, upon seeing this scene, intervened. He confronted the aggressor about his behavior, and the aggressor raised his cane toward him in a threatening gesture.

At that moment, the defendant threw a single punch to his face. The elderly man fell to the ground, struck his head against the sidewalk and died days later.

What was being judged?

Although his intention was not to kill, but rather to stop an assault, the result was a death. The question then was to determine whether that conduct should be classified as:

  • Gross negligent manslaughter, with more severe penalties.
  • Ordinary negligent manslaughter, with lighter penalties.

What did the Supreme Court say?

The High Court rejected gross negligence. Why?

  • He acted on an altruistic impulse, defending an assaulted woman.
  • He could not reasonably foresee that a punch would cause death.

What are the penalties for involuntary manslaughter?

The penalties for involuntary manslaughter vary considerably depending on the degree of negligence (gross or ordinary), and the context in which the act occurs, such as during vehicle operation or in the exercise of a profession.

Manslaughter by gross negligence

When the perpetrator’s conduct involves a clear, manifest and gross violation of the duty of care. It is understood that they acted recklessly, without respecting the minimum precautionary standards required of any citizen.

Example: firing a weapon without looking in a public area, driving at extreme speeds, leaving a dangerous element unattended on a public road, etc.

The penalty for manslaughter by gross negligence is 1 to 4 years in prison.

Manslaughter by ordinary negligence

This category recognizes that there was carelessness or lack of diligence, but without reaching the level of extreme gravity. And it applies when the defendant acted carelessly, impulsively or without foreseeing a risk that was not entirely evident, in a context of tension or urgency.

Example: intervening in a fight and pushing the aggressor, who falls, hits himself and dies. The result is fatal, but there was no clearly reckless conduct.

The penalty for ordinary negligent manslaughter is 3 to 18 months in prison.
