When should a detainee request habeas corpus?

Clear signs that it’s time to act

These situations justify activating it quickly. The objective is to prevent custody from becoming illegal or to consolidate violations.

Lack of essential information (art. 520.2 LECrim)

Police must inform you immediately of:

  • Alleged facts.
  • Rights that assist you.
  • Reasons for detention.
