When should a detainee request habeas corpus?
Clear signs that it’s time to act
These situations justify activating it quickly. The objective is to prevent custody from becoming illegal or to consolidate violations.
Lack of essential information (art. 520.2 LECrim)
Police must inform you immediately of:
- Alleged facts.
- Rights that assist you.
- Reasons for detention.
If the information is not clear or complete, your right to defense is affected. Request that it be recorded in writing and activate habeas corpus so the judge can verify legality.
Refusal to access the «essential elements» of the police report
